Terms and Conditions


Throughout the following Terms & Conditions “the photographer” shall refer to Luna Duric who trades as Le Nouveau Départ. “The client(s)” shall refer to any given persons having completed a booking on the Le Nouveau Départ business website. Unless expressly agreed by the photographer in writing, these Terms and Conditions cannot be in any way varied in any way by the client(s).

1. COPYRIGHT
i. As per the copyright Designs and Patents Acts, the copyright of the images is assigned to the photographer. 

2. DISPLAY
i. Any photographs covered by this contract shall hereby be allowed for the photographer to display and to use for business promotion in advertising, brochures, magazine articles, websites, sample albums etc.

3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION
i. Even though every realistic effort will be made to comply with client(s)(s) requirements, photographs taken during the course of the event will be at the discretion of the photographer.

ii. Special requests are not binding instruction, although every effort is made to comply with the client(s)'s wishes. The Photographer/s will do their best to honour the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather an the availability and willingness of subjects.

iii. For a booking involving certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to use may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view or location restrictions should this be the case.

iv. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.

v. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

4. PAYMENT
i. Full payment of the quoted fee on the Le Nouveau Départ website will confirm your booking, as well as full acceptance of the terms and conditions as published on the Le Nouveau Départ website. Refunds will only be issued in accordance with the Refund Policy quoted on the Le Nouveau Départ website and in the confirmation email.

5. FORCE MAJEURE
i. In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid.

ii. Should the photographer be unable to attend on the shoot date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown etc. – they will endeavour to either put the client(s) in touch with another photographer in the event they are or provide them with the option of rescheduling their shoot. Alternatively a full refund can also be issued.

6. DIGITAL NEGATIVE FILES
i. All digital negatives (computer files) remain the property of the photographer. All digital shoot packages include a copy of the digital negatives to the client(s) for their own non-commercial use.

ii. Should the digital negative files be lost, damaged of destroyed for the reasons beyond control, the photographer liability shall be limited to a full refund of any deposits and fees paid but shall not include a refund for any goods already received.

7. ON THE DAY
i. The photographer will be the sole professional still photographer at the venues specified, however another member of the team may come along to take video footage for marketing purposes. The client(s) have the option to opt out of this by explicitly stating so in writing via email before or on the day of the shoot.

ii. The client(s) can bring additional people to the shoot, however they will not be permitted in the photographs unless previously requested by the client(s), which comes with an extra charge of £20.

 

iii. Any personal items carried by the client(s) are their own liability and loss, breakage or theft of such items will not be the photographer’s responsibility.

 

iv. Any extra costs such as travel, food and beverage, or other expenses not specified in the booking will be at the client(s) private cost

8. PERSONAL ACCIDENT
i. Any directions issued to client(s)s, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

9. CANCELLATION FEES
i. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:

ii. Cancellation 48h or more before the shoot day, free of charge.

iii. Cancellation with less than 48h to go until the shoot, full price for the complete photographic coverage booked.



10. DELIVERY
i. The photographer will endeavour to deliver digital negative files as quickly as possible. However this could take up to 2-4 weeks during busy periods.
